Definitions

Customer: any professional or natural person capable, within the definition of articles 1123 and thereafter of the Civil Code, or legal person who visits the Website subject to these terms and conditions.

Content: all the elements forming the information present on the Website, in particular texts, images and videos.

Customer information: hereinafter referred to as ‘Information’, this corresponds to all personal data that may be held by MISSIONS PUBLIQUES  for the management of the European Space Talks campaign website for the European Space Agency (ESA) for the management of your account, customer relationship management and for analytical and statistical purposes.

User: Internet user connecting and using the aforementioned site.

Personal information: ‘Information that allows, in any form whatsoever, directly or otherwise, the identification of the persons to which it applies” (Article 4 of Law #78-17 of 6 January 1978).

The terms ‘personal data’, ‘data subject’, ‘subcontractor’ and ‘sensitive data’ have the meanings defined by the General Data Protection Regulation (GDPR #2016-679).

Use of the spacetalks.net Website implies full acceptance of the terms and conditions set out below. These terms of use may be modified or supplemented at any time and users of the spacetalks.net website are therefore invited to consult them regularly.

This website is normally accessible to users at all times. Interruptions for technical maintenance may however occur on decision by MISSIONS PUBLIQUES, which will always endeavour to inform users of the dates and times of maintenance in advance. 4. Contractual limitations on the technical data

This site uses JavaScript technology. The website can not be held responsible for material damage related to its use. In addition, the website user agrees to access the site using recent equipment that does not contain any viruses and with a latest-generation, up-to-date browser. The spacetalks.net website is hosted by a provider within the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: No. 2016-679).

The goal is to provide a service that ensures optimal accessibility. The host ensures continuity of its service 24 hours a day, all year round. However, it reserves the right to interrupt the hosting service for the shortest possible periods of time, most notably for maintenance purposes, to improve its infrastructures, due to a failure in its infrastructures or if the Services generate traffic deemed to be abnormal.

MISSIONS PUBLIQUES and the hosting provider cannot be held responsible in case of malfunction of the Internet service, telephone lines or hardware and telephone equipment related to congestion of the network preventing access to the server.

5. Intellectual property and counterfeits

MISSIONS PUBLIQUES owns the intellectual property rights and the rights to use or reproduce all the elements available on this website, including text, images, graphics, logos, videos, icons and sounds. Any reproduction, representation, modification, publication, adaptation of all or part of the elements on the website, whatever the means or the process used, is prohibited, unless prior written authorisation is obtained from MISSIONS PUBLIQUES.

Any unauthorised use of the website or any of the elements it contains will be considered as an infringement and subject to legal proceedings in accordance with the provisions of Articles L.335-2 and thereafter of the Intellectual Property Code.

6. Limitations of liability

MISSIONS PUBLIQUES acts as publisher of the site. MISSIONS PUBLIQUES is responsible for the quality and veracity of the Content it publishes.

MISSIONS PUBLIQUES cannot be held responsible for any direct and indirect damage caused to the user’s equipment when accessing the spacetalks.net website and resulting either from the use of equipment that does not comply with the specifications indicated in Point 4, or from the appearance of a bug or incompatibility.

Furthermore, MISSIONS PUBLIQUES cannot be held liable for any consequential damages (e.g. a loss of market or loss of an opportunity) following use of the spacetalks.net website. Interactive spaces (e.g. sending in questions via the Contact page) are available to users. MISSIONS PUBLIQUES reserves the right to delete, without prior notice, any content deposited in this space if it breaches the legislation in force in France, especially the provisions on data protection. 7. Management of personal data

The Client is informed of the regulations concerning marketing communication, the Law of 21 June 2014 on Confidence in the Digital Economy, the Data Protection Act of 6 August 2004 and the General Regulation on Data Protection (RGPD 2016-679).

7.1 Persons responsible for the collection of personal data

For the Personal Data collected for creation of the User’s personal account and their browsing on the Website, the person in charge of Personal Data processing is: Missions Publiques. MISSIONS PUBLIQUES represented by Yves Matthieu, its legal representative

With regard to the processing of the data that it collects, MISSIONS PUBLIQUES agrees to comply with the legal provisions in force. In particular, it is up to the Customer to establish for what purposes their data will be processed, to provide their own prospects and customers with full information on the processing of their personal data when they obtain their consent, and to maintain a record of processing operations that reflect the reality. Whenever MISSIONS PUBLIQUES processes Personal Data, MISSIONS PUBLIQUES takes all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which MISSIONS PUBLIQUES processes it.

7.2 Purpose of the data collected

MISSIONS PUBLIQUES is likely to process all or part of the data:
to improve navigation on the Website: usage data, computer equipment used for browsing
to run communication campaigns (newsletter and other emails): email address
in the context of a job search: name, email address, telephone number, address.

MISSIONS PUBLIQUES does not market your personal data which is therefore only used by necessity or for statistical purposes and analyses.

7.3 Right of access, rectification and opposition

In accordance with the European regulations in force, Users of spacetalks.net have the following rights:
right of access (GDPR Article 15) and rectification (GDPR Article 16), right to update and complete User data, right to block or erase User data of a personal nature (GDPR Article 17) when it is inaccurate, incomplete, equivocal, out of date, or when its collection, use, communication or storage is prohibited

right to define the fate of the User data after their death and to designate a third party to whom MISSIONS PUBLIQUES should communicate (or not) their data.

As soon as MISSIONS PUBLIQUES becomes aware of a User’s death, and in the absence of instructions from them, MISSIONS PUBLIQUES undertakes to destroy their data, unless its retention proves necessary for probative purposes or to fulfil a legal requirement.

If the User wishes to know how MISSIONS PUBLIQUES uses their Personal Data, or to ask to rectify or oppose its processing, the User can contact MISSIONS PUBLIQUES  in writing at the following address:

In this case, the User must indicate the Personal Data that they would like MISSIONS PUBLIQUES to correct, update or delete; they should provide an ID document to identify themselves (identity card or passport).

Requests for the deletion of Personal Data will be subject to the obligations imposed on MISSIONS PUBLIQUES by the law, particularly as regards the storage or archiving of documents. Finally, Users of spacetalks.net can file a complaint with the supervisory authorities, most notably the CNIL (https://www.cnil.fr/fr/plaintes).

7.4 Non-disclosure of personal data

MISSIONS PUBLIQUES is prohibited from processing, hosting or transferring the Information collected on its Customers to a country located outside the European Union or recognized as ‘unsuitable’ by the European Commission without informing the Customer beforehand. However, MISSIONS PUBLIQUES remains free to choose its technical and commercial subcontractors on condition that they provide sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR #2016-679).

MISSIONS PUBLIQUES undertakes to take all the necessary precautions to uphold the security of the Information and in particular to ensure that it is not communicated to unauthorised persons. However, if an incident affecting the integrity or confidentiality of the Customer’s Information is brought to the attention of MISSIONS PUBLIQUES, it will promptly notify the Customer and inform them of the corrective measures taken. Furthermore, MISSIONS PUBLIQUES does not collect any ‘sensitive data’.

The Personal Data of the User may be processed by MISSIONS PUBLIQUES subsidiaries and subcontractors (service providers), exclusively in order to achieve the purposes of this policy.

Within the limits of their respective attributions and for the purposes mentioned above, the people most likely to have access to the data of MISSIONS PUBLIQUES Users are mainly our Customer Service agents.

Management of the Missions Publiques newsletter and its database is entrusted to the following service provider: Mailchimp, an American company (The Rocket Science Group LLC, 675 Ponce de Leon Avenue NE, Suite 5000, Atlanta Georgia 30308, USA).

8. Incident Notification

Whatever efforts are made, no method of transmission over the Internet and no method of electronic storage is completely secure. We cannot therefore guarantee absolute security. If we become aware of a security breach, we will notify the affected Users so that they can take appropriate action. Our incident reporting procedures take into account our legal obligations at both national or European levels. We are committed to keeping our customers fully informed on all matters relating to the security of their account and providing them with all the information they need to help them meet their own regulatory reporting requirements.

None of the personal information relating to Users of the spacetalks.net website is published without the Users’ knowledge, nor exchanged, transferred, assigned or sold on any medium to other parties. Only in the hypothesis of a buyout of MISSIONS PUBLIQUES  and its rights would the transmission of such information be permitted to the prospective buyer, who would in turn be bound by the same obligation to store and modify data concerning Users of the  spacetalks.net website.

Security

To ensure the security and confidentiality of Personal Data and Personal Health Data, MISSIONS PUBLIQUES uses networks protected by standard systems such as firewalls, pseudonymisation, encryption and passwords.

9. Hypertext links “cookies” and internet tags

9.1. “COOKIES”

MISSIONS PUBLIQUES is likely to process User information concerning their visit to the website, such as the pages consulted, or the searches carried out. This information helps MISSIONS PUBLIQUES improve the website content and the User’s browsing experience.

10. Applicable law and jurisdiction

Any dispute relating to use of the spacetalks.net Website is subject to French law. Except in cases where the law does not permit, exclusive jurisdiction is conferred on the competent courts of Paris
